Attack Against a Transgender Person on an Intercity Bus

On 24 July 2025, the first reported person, S.D., told the victim, who is a transgender person, to move to another seat on the bus after her assigned seat was located near him. He threatened her by saying, “Come on, sit over there. Don’t argue with me now, or I’ll call security.” Later, when the victim coughed, the reported person told her, “Stop coughing, you’re going to infect me.”

On 4 November 2025, the first reported person, a driver employed by the transport company DTTU Euro Tourist Club DOOEL Tetovo, told the victim, “Get off, get out, you are not allowed to ride,” when she attempted to board the bus operating on the Skopje–Tetovo route at the bus stop on Partizanski Odredi Boulevard. The driver then became agitated and began pushing her towards the bus exit, using physical force by twisting her right arm upwards and pushing her in the chest towards the door.

On 13 November 2025, again on the same Skopje–Tetovo bus route at 10:30 a.m., the first reported person refused to sell her a bus ticket, stating: “Get off, you cannot ride, leave the bus.” He further told her: “It is not mine (the bus), I have been told that you are not allowed to ride with us. Please leave, otherwise I will call the police.”

Through these actions, the reported person intentionally committed two temporally connected acts constituting repeated commission of the same offence, taking advantage of the same ongoing relationship, the same circumstances, or other similar conditions. In doing so, he incited hatred, discord, and intolerance on the grounds of sex, gender, gender identity, and belonging to a marginalized group. He inflicted bodily injury upon the victim and caused her feelings of humiliation, degradation, and distress.

The second reported parties, through the policy that the victim was not permitted to ride on the bus, which resulted in the first reported person expelling her from the bus, incited hatred, discord, and intolerance on the grounds of sex, gender, gender identity, and membership in a marginalized group, and caused the victim feelings of humiliation, degradation, and distress.

Furthermore, the victim submitted a complaint to the Commission for Prevention and Protection against Discrimination, which, in Opinion No. 08-290/2 of 11 March 2026, established that direct discrimination had been committed against the person on the grounds of sex, gender, and gender identity in the area of access to goods and services by the transport company Eurotourist and by S.D., a driver on an international bus route employed by the transport company “Eurotourist.”
